General Terms and Conditions of Business Hotel "Zum Turm"


§ 1 Gastaufnahmevertrag

The accommodation contract is concluded as soon as the room has been booked and confirmed either verbally or in writing. The conclusion of the accommodation contract obliges the contracting parties to fulfil the contract, regardless of the duration for which the contract is concluded.


Our cancellation policy:

We only charge cancellation fees if we are unable to re-let the room at short notice.


     Up to 28 days before the guest's arrival, the accommodation contract may be cancelled free of charge by either party by means of a unilateral declaration.

     after that, 80% of the agreed room price.

      If you make an equivalent booking with us within 12 months of this date, we can credit 60% of the cancellation costs to your new booking.

      Other agreements require written confirmation.


§ 2 late arrival

Please inform us if you plan to arrive after 6 p.m. For verbal bookings without a credit card guarantee, the hotelier reserves the right to reallocate rooms booked after 6 p.m. in order to avoid the above-mentioned cancellation fees, which we will charge in the event of non-occupancy. Bookings will not be upheld without written confirmation and a credit card guarantee.


§ 3 Arrival and departure times

Reserved rooms are available to guests from 3 p.m. (day of arrival) until 11 a.m. (day of departure). Changes to arrival or departure times must be agreed in advance. However, even after agreement, guests have no contractual right to earlier or later provision of hotel rooms. After 1 p.m., the hotel has the right to charge the room rate for an additional night. A day room is calculated from the specified room rate minus the breakfast price.


§ 4 Force majeure

Furthermore, the hotel is entitled to withdraw from the contract in the event of force majeure or other circumstances beyond the hotel's control without incurring any liability for damages to the customer.


§ 5 Service provision

The hotel is obliged to provide the services ordered by the guest and confirmed by the hotel.


§ 6 payment obligation

The guest is obliged to pay the prices agreed with the hotel for this.


§ 7 We endeavour to fulfil your wishes

Especially for rooms booked online and at short notice, it may not be possible to fulfil every request. To ensure your request is fulfilled, please book by telephone on 06774 9220-0.


§ 8 Non-smoking room

Our hotel rooms are strictly non-smoking rooms. If guests smoke in their rooms or by open windows, we will charge them a gross amount of €50 towards the cleaning costs (curtains, furniture, bedding, etc.). If the room cannot be rented out the next day due to the strong smell of smoke, an additional night will be charged at the hotel rate.


§ 9 Domestic animals


Small pets and dogs are permitted in some rooms upon request for a cleaning fee of €15 per night. As we reserve some hotel rooms for guests with allergies, animals are not permitted in these rooms. Failure to comply will result in an additional cleaning fee of €150 gross..


Admission requirements:


· Dog owners must bring their own dog blanket, or one can be borrowed from our reception upon arrival.


· The dog owner is obliged to point out any behavioural abnormalities in their dog, especially if it snaps, bites, growls persistently at people or is subject to the fighting dog ordinance.

     

· In the interests of other guests, only vaccinated and dewormed animals are accepted. Furthermore, animals must be house-trained, well-groomed and free of infectious pathogens such as mites, fleas, lice, etc.


·The dog must have a valid vaccination against the following animal diseases: S H L T P (distemper, hepatitis, leptospirosis, rabies, parvovirus). The vaccination certificate must be presented on request.


Liability


· We require all dogs to have pet owner liability insurance. The owner or their insurance company is liable for any damage caused by the animal. Claims for damages by guests are excluded unless they are based on intent or gross negligence on the part of the hotel or its employees. § 10  Lost property

Items left behind by the customer will only be forwarded upon request, at the customer's risk and expense.


§ 11 Damage/losses

The customer shall be fully liable for any damage or loss (e.g. damage to premises, loss of items, etc.) occurring during the term of the contract, unless the damage is the responsibility of the hotel, which must be proven by the customer.


§ 12 Terms of payment

Hotel bills are payable upon departure, or within 14 days of receipt of the invoice without deduction if written confirmation of payment has been provided. In the event of late payment, the hotel is entitled to charge interest at a rate of 4% above the Bundesbank discount rate. A reminder fee of € 5.00 is payable for each reminder..


§ 13 Prices

Our prices are final prices, including statutory VAT.

For longer-term bookings, we reserve the right to recalculate prices depending on market conditions, VAT, cultural tax, tourist tax rates and seasonality.


§ 14 Nutzungsvereinbarung über die Nutzung eines Internetzugangs über W-LAN


1. Permission to share a Wi-Fi connection

The owner provides WiFi internet access in his hotel. As a courtesy, he allows guests to use the WiFi internet access for the duration of their stay at the hotel. Shared use is a service provided by the hotel and can be revoked at any time. By logging into our system, guests agree to the terms of use in §14.

The guest does not have the right to allow third parties to use the Wi-Fi. Responsibility for the transmitted data remains with the password recipient.

The owner does not guarantee the actual availability, suitability or reliability of the internet access for any purpose. The owner is entitled at any time to discontinue the operation of the Wi-Fi in whole, in part or temporarily, to allow additional users and to restrict or exclude the guest's access in whole, in part or temporarily. In particular, the owner reserves the right, at its own discretion and at any time, to block access to certain pages or services via the Wi-Fi (e.g. pages glorifying violence, pornographic pages or pages subject to a charge).

The co-user is solely responsible for creating all technical and organisational conditions necessary for the use of the Wi-Fi.


2. Zugangsdaten

Access is granted by entering access codes. The access data is intended for the guest's personal use only and may not be passed on to third parties under any circumstances. The guest undertakes to keep their access data confidential. The owner reserves the right to change access codes at any time.


3. Risks of Wi-Fi use, limitation of liability

Guests are advised that the Wi-Fi only provides access to the internet; virus protection and a firewall are not available. Data traffic generated using the Wi-Fi is unencrypted. The data may therefore be viewed by third parties. The owner expressly points out that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) may infect the end device when using the Wi-Fi.

Use of the Wi-Fi is at the guest's own risk. The owner accepts no liability for damage to the guest's computer resulting from use of the internet access, unless the damage was caused by the owner intentionally or through gross negligence.


4. Safety

Data transmission is free of charge but unencrypted.

The data may therefore be viewed by third parties.

Please bear this in mind, especially when transmitting confidential or company data. The Wi-Fi only provides access to the internet. The content accessed is not checked by the owner, in particular with regard to whether it contains malware. Use of the Wi-Fi is at the co-user's own risk. The owner expressly points out that there is a risk of malware (e.g. viruses, Trojans, worms, etc.) getting onto the end device when using the Wi-Fi.


5. Responsibility and exemption from claims

Guests are responsible for the data transmitted via the Wi-Fi, the services used and any legal transactions carried out. If guests visit chargeable websites or enter into any liabilities, they shall bear the resulting costs. They are obliged to comply with the applicable law when using the Wi-Fi.

• not use the Wi-Fi network to access or distribute immoral or illegal content;

• not unlawfully reproduce, distribute or make available any copyright-protected goods;

• comply with the applicable youth protection regulations;

• not send or disseminate any harassing, defamatory or threatening content;

•not to use the Wi-Fi to send mass messages (spam) and/or other forms of unauthorised advertising.


The co-user indemnifies the hotelier against all damages and claims by third parties based on illegal use of the Wi-Fi by the co-user and/or a breach of this agreement; this also extends to costs and expenses associated with the claim or its defence. If the guest recognises or should recognise that such a legal violation and/or breach has occurred or is imminent, they shall notify the hotelier of this circumstance.
